Separation under marriage law


Nature

Agreement between spouses not to live together, or situations when one leaves the other without the other's agreement but for a legally justifiable cause, may be reinforced by judicial decree providing for the same economic and child custody arrangements as divorce, but under which the couple continue to enjoy certain conjugal benefits. Such legal separation implies that the individuals involved may marry no-one else, and may constitute a barrier to divorce at a later stage.
